This agreement is between the applicant (which term shall mean
and include its heirs, successors, and assigns) on one part; and,
"Beam" which term shall mean and include Beam Money (P) Limited,
with its registered office at Enterprise, D-128-129, 402, Terrace
Floor, Okhla Industrial Area, Phase 1, New Delhi, 110020, India,
its affiliates, group companies, successors, licensees, and
assigns, on the other part.
I. Becoming Beam Loyalty Rewards Member: Applicant
confirms that he/she has signed the application overleaf after
going through and having fully understood the terms and conditions
which have been explained in the language known to him/her and
accepts this agreement. On accepting the application and
registering the applicant, Beam shall allot a Beam Loyalty Rewards
Account number (BLRA) whereafter the applicant shall become and be
referred as Beam Loyalty Rewards Member. The Beam Loyalty Rewards
Member's BLRA shall be updated, as per rules in vogue from time to
time, whenever any transaction is made by the Beam Loyalty Rewards
Member using his/her Beam Customer/Subscriber Account (BSA) that
was established on the applicant registering with Beam and becoming
Beam Customer/Subscriber. The mobile number and Email ID mentioned
by the applicant in the application shall, on registration, become
the Registered Mobile Number (RMN) and Registered Email (REM) of
the Beam Loyalty Rewards Member. The Beam Loyalty Rewards Member's
username shall be the BLRA or the RMN; and password shall be the
SPIN (as amended) that was established on the applicant registering
with Beam and becoming Beam Customer/Subscriber. Every time Beam
Customer/Subscriber does a transaction that qualifies the
transaction for awarding Beam Loyalty Reward Points (BLRP) the
applicable BLRP shall be credited to the BLRA. It is clearly
understood by the applicant that the BSA and BLRA and independent
accounts which cannot be intermingled in any manner or circumstance
whatsoever.
II. Acceptance of Terms of Use for Beam Loyalty Rewards
Membership/Account: Please read these terms and conditions
carefully. Availing the Beam Loyalty Rewards Membership, BLRA as
defined herein as also on Beam's website www.beam.co.in (Beam
Website), expressly means that you accept and agree to abide by
these terms and conditions as well as any other which might be
stipulated by Beam from time to time without prior notice. In case
you do not agree to abide by these terms and conditions as also the
aforesaid, please do not avail Beam Loyalty Rewards Membership.
TERMS OF USE :
1. You must be 18 years or above age for being eligible for
applying and obtaining Beam Loyalty Rewards Membership.
2. You must provide all information in the application form as
well as provide required valid documents including for Know Your
Customer (KYC) for becoming Beam Loyalty Rewards Member.
3. You will be solely responsible for maintaining the
confidentiality about the information of Beam Loyalty Rewards
Membership including keeping password i.e. SPIN secure.
4. Beam will not be liable / responsible for any loss or damage
caused to any individual from failure by you to maintain the
confidentiality of BLRA and SPIN.
5. You do not have any authority to use Beam's Loyalty Rewards
system for any illegal or unauthorized purpose / intention nor may
he/she, violate any laws and/or terms and conditions issued from
time to time by Beam - including but not limited to those mentioned
on Beam Website.
6. You will be solely responsible for all activities and
contents (data, graphics, photos, and links) that is
uploaded/maintained/published in your BLRA.
7. You must not transmit any worms or viruses or any code of
destructive nature.
8. These terms and conditions as well as any subsequent
amendments thereof are part of a contract between Beam and you.
9. Any duplication / modification / alteration / change /
addition of Beam Loyalty Rewards Membership Card without prior
written consent of Beam will be subject to its cancellation.
10. Beam shall not be liable / responsible in any manner for any
defects / damages whatsoever in the product/merchandise/goods /
tools/services provided by Beam/Beam's merchant, which shall
include and not be limited to any deficiency in services/skill.
Beam does not warranty/guarantee in any manner whatsoever, against
any damage, defect, pilferage or loss for the aforementioned
goods/services.
11. BLRP is not subject to exchange or withdrawal by way of
cash.
12. Beam Loyalty Rewards Membership Card contents / data in the
card (electronic and/or physical) is the exclusive property of Beam
only. You unconditionally agree to surrender / destroy the Beam
Loyalty Rewards Membership Card on its cancellation/termination as
per the direction/ instructions of Beam.
13. You agree to pay the full amount of consideration of Beam
Loyalty Rewards Membership fee as per schedule stipulated by Beam
from time to time.
14. Beam shall not be responsible for any
misuse/misappropriation of the BLRP.
15. Beam reserves the unconditional and exclusive right to
amend/ change / modify / alter or withdraw the Beam Loyalty Rewards
Membership programme without any prior notice.
16. All disputes pertaining to defect in the
product/merchandise/goods / tools/services provided by Beam and/or
any deficiency in product/services/skill availed through the Beam
Loyalty Rewards Membership programme will be resolved by Beam only
at its sole discretion. Decision of Beam in this regard shall be
without prejudice, full and final and binding on you.
17. It is mutually agreed that you will pay all the taxes /
levies / assessment / charge / duty applicable as per code of
taxation.
18. The Beam Loyalty Rewards Membership Card can be used by you
only, and that transfer of said card in any manner whatsoever is
not allowed under any circumstance. Beam hereby reserves the right
to cancel / terminate the said card without any prior notice.
19. The Beam Loyalty Rewards Membership card is valid initially
for one year from the date of activation.
20. Non use of the Beam Loyalty Rewards Membership card up to
twelve (12) continuous months will render the same for
deactivation.
21. Beam Loyalty Rewards Membership and BLRP will be valid for
transactions at Beam authorized merchants and franchisees
only. BEAM LOYALTY REWARDS MEMBERSHIP POINTS CALCULATION
22. BLRP points which you will earn through transactions will be
added to your BLRA account within seven (7) days of transaction or
as per schedule decided by Beam from time to time.
23. In case of Refund and Return transaction BLRP points will
not be added.

25. BLRP will be calculated in a whole and will not be
considered as fractions/decimals. In case of fractions/decimals the
BLRP points will be round off with previous number.
26. BLRP points from the your BLRA cannot be pooled or combined
and or intermingled with the BLRP points of another Beam Loyalty
Rewards Member's BLRA.
27. If you do not use your Beam Loyalty Rewards Memberships card
to accumulate and/ or redeem BLRP points for a continuous period of
twenty four (24) months, the Beam Loyalty Rewards Memberships
points accumulated by you and your Beam Loyalty Rewards Membership
account will expire without any notice. All BLRP points collected
by you which may be lying unused at the time of expiry shall
lapse.
REDEMPTION OF BEAM LOYALTY REWARD POINTS - TERMS AND
CONDITIONS:
28. Beam Loyalty Rewards Memberships customer rewards program is
managed, operated, developed, promoted and marketed by Beam and
offers benefits, facilities or arrangements to members by reason of
their membership into the program, whereby certain BLRP points are
collected on every transaction qualified to earn BLRP activity made
by you within Beam network and such BLRP points may be used by you
for redemption through the Beam Loyalty Rewards rewards catalog
published on Beam Website.
WARRANTIES / GUARANTEE:
29. The warranty and guarantees as applicable on the
products/services is the sole responsibility of the vendor/merchant
supplying the product/service/skill. Beam shall not be liable
/responsible in any manner whatsoever pertaining to any
defect/damage/deficiency in service in the
product/merchandise/goods/tools/services/skill provided by Beam
Loyalty Rewards Membership or any deficiency in services/skill
availed through the Beam Loyalty Rewards programme. However
guarantee and warranty of the product/service shall be transferred
as received from the manufacturer/distributor/vendor/merchant. You
must contact the respective
manufacturer/vendor/distributor/merchant in case of any complaint
including deficiency in service.
30. All products/services displayed on the Beam Website's
section pertaining to Beam Loyalty Rewards / catalogue and the same
are subject to availability of the goods/services and supplier
warranties/guarantee at the time of their redemption. Beam will not
be responsible by whatsoever manner with respect to the services/
product/merchandise/goods / tools/skill provided under Beam Loyalty
Rewards programme including any deficiency in services/skill
availed through Beam Loyalty Rewards obtained under the said
program.
PRODUCT DELIVERIES:
31. All redemption orders received / placed through the Beam
Website's Beam Loyalty Rewards section will be delivered within
sixty (60) working days however Beam will not be responsible in any
manner whatsoever in case of further delay caused due to (a) of the
whole or any part of the performance by of Beam, or its
vendor/merchant, of its obligations under this agreement is
prevented, hindered or delayed or otherwise made impracticable by
reason of any event beyond the reasonable control of Beam including
but not limited to strikes, labor disputes, floods, fires,
accidents, earthquakes, riots, explosions, wars, hostilities, acts
of government or any other cause of like or different character
("Force Majeure Event"), the party whose performance is thus
prevented, hindered or delayed shall be excused from such
performance during the continuance of such Force Majeure Event. On
the happening of such Force Majeure Event, the parties shall
immediately consult each other in order to find an equitable
solution and shall use all reasonable effort to minimize the
consequences of the Force Majeure Event.
32. Redemption orders from members once given to Beam cannot be
canceled or changed. Goods /services i.e. Beam Rewards once
delivered cannot be returned, or cancelled or exchanged for cash by
you.
33. You are to ensure that your mailing address details given in
the attached application are legible and correct. If not, please
contact Beam Customer Care and have the details updated by
providing valid relevant supporting documents as required.
34. If you have not mentioned correct residential address or is
not available at the mentioned address at the time of delivery of
product/service the said product/service will be delivered to the
person available at the mentioned address and Beam will not be
responsible for such delivery of product/merchandise/goods /
tools/service/skill provided under Beam Loyalty Rewards Membership
programme or any services / skill availed under the same.
RETURN / EXCHANGE POLICY:
35. If any product/merchandise/goods / tools/service are found
damaged condition or if any deficiency / defect in the services /
skill is found, you will be liable to communicate the same fact to
Beam on the registered address in written or through electronic
communication within seven days of receipt of the
product/service/skill.
36. All damaged product /merchandise/goods / tools/services need
to be sent by you only. You will have to send the damaged/deficient
product/service from where the same was received and intimate Beam
of the same.
37. Beam will not be responsible for products/service or
vouchers stolen, damaged/mutilated/destroyed or lost in transit
before delivery to you. The aforesaid responsibility entirely lies
with the fulfillment agency and/or courier company which is used
for fulfillment of the Beam Reward.
38. You must strictly follow the Beam Rewards
merchant/vendor/partner's designated procedures to exchange
defective merchandise.
39. Under any circumstances will the Beam Rewards be either
refunded or exchanged for BLRP points or cash.
INDEMNITIES
40. Product/service availability and points of the
products/service under the Beam Loyalty Rewards programme's reward
catalogue are subject to change without prior notice.
41. There will be slight changes in model, color and/or features
of the product/service subject to availability that might be sent
to you by vendor.
42. Selection of products/services offered for redemption under
the Beam Loyalty Rewards programme are and will be at the sole
discretion of Beam and is liable to changed without prior
notice.
43. Beam will not be responsible in any manner whatsoever where
any supplier/vendor/merchant of the products/service under Beam
Loyalty Rewards programme, withdraws, cancels, alters or amends the
said products/service in any manner.
44. Product/service image displayed on the Beam Loyalty Rewards
catalogue are representative picture, colors and specifications
only and are subject to change as per availability.
45. Beam shall not be responsible for changes to, or
discontinuance of, any merchant or partner product, merchandise, or
service, of if any merchant or partner/vendor withdrawals from the
Beam Loyalty Rewards programme, or for any effect on or devaluation
of rewards caused by such change, discontinuance, or withdrawal.
You may not rely upon the continued availability of any Beam
Loyalty Reward or award/redemption level.
GENERAL
46. This Agreement can be terminated by either party giving a
written notice of thirty (30) days to this effect.
47. Neither party hereto shall be liable to the other for its
failure to comply with any of the covenants contained herein
provided where such a failure is the result of the force majeure,
interalia lockouts, strike, fire, floods, earthquakes, storm, act
of God, governmental action, or any other reason beyond control of
the parties (Force Majeure).
48. This agreement cancels and supersedes any and all prior
agreement written or oral, expressed or implied between you and
Beam.
49. That any indulgence and or forbearance accorded to you by
Beam shall not deemed to have modified and or forgone Beam's rights
and remedies as contained in this agreement as amended and absolve
you from discharging your obligations and duties contained in this
agreement as amended.
50. All disputes pertaining to this agreement and transactions
hereunder will be resolved by Beam and the decision of Beam in this
regard shall be final and binding on you.
51. Beam reserves its absolute right to modify, add/delete the
terms and conditions, as amended, at its sole discretion without
prior notice and any liability to any person.
52. Any notice or intimation required to be given by either
party shall be deemed to have been duly served if sent by
electronic mail, registered post to the respective parties by their
name and styles and address contained herein/in the application
attached.
53. In case of any dispute arising out of this Agreement the
same shall be settled through arbitration by a Sole Arbitrator. The
Sole Arbitrator shall act as per the provisions of the Indian
Arbitration and Conciliation Act 1996 as amended, and his decision
shall be binding upon the parties. It is understood and agreed by
both the parties that Chairman of Beam who is nominated by both you
and Beam to nominate the Sole Arbitrator. The venue of arbitration
shall be Delhi, India only and each party shall equally share the
cost of the Sole Arbitrator unless awarded otherwise.
54. The arrangements under this agreement are subject to the
exclusive jurisdiction of Delhi Courts only. Further all
transactions between the parties mentioned herein shall be deemed
to have been made exclusively in Delhi only. Laws of India will
only apply.
55. You agree to receive promotional SMS and calls from
Beam.
